Terms & Conditions

1. Overview of Services

Ducket Productions provides content-related services including, but not limited to:

  • Podcast setup and coaching

  • Content growth coaching

  • Twitch and streaming guidance

  • Video editing services (long-form and short-form content)

  • Content strategy consultation

Services may be delivered via digital communication, video calls, or file delivery platforms. All services are provided based on the information and materials supplied by the client.
 

2. Service Packages

Service packages are defined at the time of purchase or agreement and may include:

  • One (1) long-form video edit

  • Up to ten (10) short-form clips

  • Coaching sessions (30 or 60 minutes)

Any work requested outside the agreed scope may be subject to additional charges.
 

3. Client Responsibilities

The client agrees to:

  • Provide all required footage, audio, and materials promptly

  • Supply clear instructions, expectations, and preferences before work begins

  • Provide branding elements where applicable (logos, colours, fonts, styles)

  • Communicate feedback clearly and within a reasonable timeframe

Delays in providing materials or feedback may result in project delays. Ducket Productions is not responsible for delays caused by the client.
 

4. Turnaround Times

Turnaround times will be agreed prior to starting work.

Timeframes may vary depending on:

  • Project complexity

  • Quality of submitted files

  • Client responsiveness

All delivery timelines are estimates and may be extended where necessary.
 

5. Revisions Policy

Revisions are limited to:

  • Long-form edits: up to 2 revision rounds

  • Short-form clips: up to 1 revision round

Revisions include:

  • Minor edits to pacing, trimming, subtitles, or audio/visual adjustments

Revisions do not include:

  • Complete re-edits due to a change in direction

  • Major structural changes not included in the original brief

  • Additional content beyond the agreed scope

Additional revisions may incur extra charges.
 

6. Payment Terms

Payment terms will be agreed before work begins and may include:

  • Full payment upfront or a deposit

  • Remaining balance due before final delivery

No final, watermark-free content will be delivered until full payment has been received.

Late payments may result in:

  • Delayed delivery

  • Suspension of services

  • Additional charges
     

7. Watermarked Previews

Draft and preview content may include visible watermarks.

Final, watermark-free files will only be delivered once full payment has been received.
Unauthorised use of watermarked content is not permitted.
 

8. Delivery of Final Files

Final deliverables will be provided in standard digital formats (e.g., MP4).

Unless agreed in writing:

  • Source files

  • Project files

  • Editable assets

are not included in delivery.
 

9. Ownership & Usage Rights

The client retains ownership of all original materials provided.

Upon full payment:

  • The client receives full usage rights to final deliverables

  • Content may be used for personal or commercial purposes

Ducket Productions retains the right to:

  • Showcase work in portfolios

  • Use content for promotional purposes

unless otherwise agreed in writing.
 

10. Content Responsibility

The client is responsible for ensuring they have the rights to all materials provided, including:

  • Video footage

  • Music

  • Images

  • Third-party assets

Ducket Productions is not liable for any copyright claims arising from client-supplied materials.
 

11. Performance Disclaimer

Ducket Productions uses proven strategies to improve content quality and performance.

However:

  • No guarantees are made regarding views, engagement, or monetisation

  • Platform algorithms and audience behaviour are outside of our control
     

12. Coaching Disclaimer

Coaching is based on experience, knowledge, and tested strategies.

The client acknowledges:

  • Results vary

  • Success depends on execution and consistency

Ducket Productions is not responsible for outcomes based on advice or guidance provided.
 

13. Communication

Clients are expected to maintain reasonable and respectful communication.

Failure to respond within a reasonable timeframe may result in:

  • Project delays

  • Temporary suspension of services
     

14. Cancellations & Refunds

  • Deposits are non-refundable once work has started

  • Clients may be charged for work completed up to cancellation

  • No refunds are provided for completed work

If Ducket Productions cannot complete the project:

  • A partial or full refund may be issued depending on progress
     

15. Rush Work

Rush projects may be accepted based on availability and may incur additional fees.
 

16. Limitation of Liability

Ducket Productions is not liable for:

  • Loss of client data

  • Issues caused by poor-quality source material

  • Platform-related performance outcomes

Liability is limited to the amount paid for the service.
 

17. Confidentiality

Client information will be handled with care and will not be shared with third parties without consent, unless required by law.
 

18. Refusal of Service

Ducket Productions reserves the right to refuse services involving:

  • Illegal content

  • Hate speech

  • Harmful or inappropriate material
     

19. Breach of Terms

If the client breaches these Terms, including non-payment, Ducket Productions reserves the right to suspend or terminate services without liability.
 

20. Indemnity

The client agrees to indemnify and hold harmless Ducket Productions from any claims, damages, or legal actions arising from:

  • Client-provided materials

  • Use of delivered content
     

21. Force Majeure

Ducket Productions is not liable for delays or failure to perform due to events beyond reasonable control, including:

  • Technical failures

  • Platform outages

  • Illness

  • Unforeseen circumstances
     

22. Data Protection

Client data will be handled in accordance with applicable data protection laws and will not be shared without consent unless required by law.
 

23. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
 

24. Amendments

Ducket Productions reserves the right to update these Terms at any time.
Clients are subject to the Terms in effect at the time of agreement.
 

25. Agreement

By engaging with or purchasing services from Ducket Productions, the client confirms they have read, understood, and agreed to these Terms & Conditions.
